Settlement Obtained in a Construction Accident

JAGHAB, JAGHAB & JAGHAB, P.C. has recently obtained a settlement in the amount of $400,000.00 for a construction worker that was struck in the eye by a piece of debris while working within an active construction site. Under New York Labor Law ‘241(6), where there is ongoing construction, demolition or excavation, owners and general contractors are obligated to use reasonable care in constructing, shoring, equipping, or guarding the site or in arranging, operating or conducting the work in that area.

In this case, the owner and general contractor of the area where the plaintiff was working in furtherance of a construction project to build residential housing units in Brooklyn, violated Labor Law ‘241(6) by failing to use reasonable care in protecting the plaintiff from this type of injury. The evidence established that the plaintiff was not provided with proper eye protection while working within the active construction site, even though it was foreseeable that debris caused by the ongoing work could strike a another worker in the eye. Plaintiff sustained an injury to his eye which caused partial blindness in that eye.
