$500,000.00: Construction Accident: 49 year old construction worker struck by a portion of a metal duct that fell while in the process of being installed in the ceiling during a school renovation project. Worker suffered an aggravation of prior shoulder injury, which required surgery. Under New York Labor Law §240(1) owners and general contractors are responsible to provide workers proper protection when they are faced with risks associated with elevation differentials required to perform certain tasks at a job site. In this case, worker was not provided with equipment necessary to safely hoist and position the metal duct, and as result, worker was injured when that duct fell striking him on the shoulder.
